Agreement to Terms

By accessing and using Flocknest, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

1. Preamble

Welcome to Flocknest. These Terms of Service govern your use of our platform and services. By using Flocknest, you agree to these terms in their entirety. Our mission is to facilitate meaningful connections between individuals based on personality compatibility.

2. Membership

2.1 Early Access Program

The first 100 users to register on Flocknest will receive complimentary access to our service for a period of three (3) months from their registration date. After this period, these users may choose to continue with a paid subscription or their access will be cancelled.

2.2 Pricing

Flocknest operates on a subscription basis. The current subscription fee is clearly displayed during the registration process. We reserve the right to modify our pricing with appropriate notice to our members.

2.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of your current billing period, after which you will lose access to the matching service.

2.4 Refund Policy

In accordance with EU consumer protection laws, you have the right to request a refund within 14 days of subscription purchase.

However, by registering with Flocknest, you acknowledge and agree that if you have received any match through our service (even one match), you are no longer eligible for a refund as the service has been partially delivered.

3. Community Standards and Membership Approval

Flocknest reserves the right to review, approve, or decline membership applications at our sole discretion. We may also cancel existing memberships if we determine that a member is not a good fit for our community or violates our community standards.

In cases where we cancel a membership due to community fit concerns, we will issue a full refund for the most recent subscription payment. This decision is made to maintain the quality and safety of our community for all members.

If you believe your membership was cancelled in error or have concerns about this process, you may contact us at support@flocknest.net. While we will review your case, please note that resolution is not always guaranteed as community standards are maintained at our discretion.

4. Matching Process

Our matching process is based on our proprietary personality assessment system. New matches are processed and distributed twice monthly, typically on the 5th and 20th of each month. These dates may vary slightly based on system processing and optimization requirements.

The personality test is designed to understand your preferences, interests, and compatibility factors. Your responses help us create meaningful connections with other members in your area.

4.1 Group Communication Issues

If you experience issues with group members not responding or participating in planned activities, you may contact our support team at support@flocknest.net. We will make reasonable efforts to address the situation, though we cannot guarantee resolution as member participation is ultimately voluntary.

5. Experiences

Flocknest may offer exclusive experiences and events designed to bring members together in person. These experiences are subject to the following terms and conditions:

5.1 Booking and Payment

Experience tickets can be purchased through our platform. Active subscribers may reserve spots for free, while non-subscribers must purchase tickets at the advertised price. All payments for experiences are processed through Stripe and are subject to their terms of service.

5.2 Booking Deadlines

Bookings for experiences close two (2) days before the scheduled event date. No bookings will be accepted within this timeframe to ensure proper event planning and coordination.

5.3 Cancellation and Refund Policy

No refunds are provided for experience bookings under any circumstances. All experience payments are final upon completion of the booking process.

Users may unbook from experiences until three (3) days before the scheduled event date. After this deadline, unbooking is not permitted through the platform. For assistance with cancellations within the three-day window, users must contact us directly by sending a direct message to @flocknest on Instagram.

5.4 Safety and Liability

Participants attend experiences at their own risk. Flocknest is not responsible for any injuries, accidents, losses, or damages that may occur during experiences. Participants are responsible for their own safety and well-being.

By booking an experience, you acknowledge that you participate voluntarily and assume all risks associated with the activity. You agree to hold Flocknest harmless from any claims, damages, or losses arising from your participation.

5.5 Event Changes and Cancellations

Flocknest reserves the right to modify, reschedule, or cancel experiences due to unforeseen circumstances, including but not limited to weather conditions, venue availability, or insufficient participation. In the event of a cancellation by Flocknest, participants will receive a full refund or credit toward future experiences.

5.6 Conduct During Experiences

Participants are expected to maintain respectful and appropriate behavior during all experiences. Disruptive, inappropriate, or unsafe behavior may result in removal from the event without refund and potential suspension from future experiences.

6. Your Account

Through your account, you can:

  • Manage your subscription status
  • Update your profile information
  • Modify your contact details
  • Review and update your personality assessment
  • Access your current and past matches
  • Book and manage experience reservations

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

7. Member Responsibilities

Members are solely responsible for:

  • Arranging and coordinating meetings with their matches
  • Choosing safe and appropriate meeting locations
  • Their own safety and well-being during meetings and experiences
  • Their own transportation and expenses related to meetings and experiences
  • Maintaining respectful and appropriate communication
  • Following experience guidelines and safety instructions

Flocknest provides the matching service and organizes experiences but does not supervise individual interactions between members or guarantee safety during events.

8. User Content and Third-Party Services

8.1 Google Account Integration

When you choose to sign up or log in using your Google account, we collect and store certain information from your Google profile, including:

  • Your Google user ID (for authentication purposes)
  • Your name
  • Email address
  • Profile picture
  • Authentication tokens (to maintain your login session)

By connecting your Google account to our service, you authorize us to access and use this information in accordance with our Privacy Policy. We use this information to:

  • Create and manage your Flocknest account
  • Personalize your experience
  • Display your profile information to other users
  • Communicate with you about our service

You can revoke our access to your Google account at any time through your Google account settings or by contacting us. However, this may limit your ability to use certain features of our service or require you to create a traditional account to continue using Flocknest.
